Britney Spears<\/strong> is out of rehab ahead of a court hearing in her DUI case.<\/p>\n

Us Weekly<\/em> has learned that the \u201cToxic\u201d singer, 44, recently checked out of a treatment facility after entering on April 12. Spears has an arraignment hearing scheduled on Monday, May 4, at the Ventura County Superior Court following her DUI arrest near her home on March 4.<\/p>\n

On Thursday, April 30, a spokesperson for the Ventura County District Attorney\u2019s Office confirmed to Us<\/em> that Spears was officially charged with one misdemeanor count of driving under the influence.<\/p>\n

\u201cWhether or not Ms. Spears will appear at the [May 4] hearing will be a decision made between her and her attorney,\u201d a rep for the DA\u2019s office told Us<\/em>. \u201cSince it is a misdemeanor charge, she is not required to attend, and her attorney can make the appearance for her.\u201d<\/p>\n

\n\t\t\tBritney Spears is back on Instagram three weeks after her DUI arrest. Spears, 44, took to the social media site on Friday, March 27, with a video featuring her son Jayden, 19, whom she shares with ex-husband Kevin Federline. (The pair are also parents of son Sean Preston, 20.) The montage featured several clips of [\u2026]\t\t<\/p>\n<\/div>\n

Their statement went on, \u201cThis DUI case will be handled according to our standard protocols. For defendants without a prior DUI history, a low blood alcohol level, and where there is no crash or injury, prosecutors typically offer what is known as a \u2018wet reckless.\u2019 This law allows a defendant to plead guilty to reckless driving involving alcohol and\/or drugs.\u201d<\/p>\n

A DA\u2019s office spokesperson explained to Us<\/em> that this type of legal outcome is \u201ccommon, particularly when a defendant demonstrates self-motivation to address underlying issues through rehabilitation or a drug and alcohol treatment program.\u201d<\/p>\n

\u201cUnder that offer, a defendant is placed on probation for 12 months, receives credit for any time spent in custody, is required to complete a DUI class, and must pay state-mandated fines and fees,\u201d the DA\u2019s office confirmed. \u201cThis offer will be extended to Ms. Spears on Monday.\u201d<\/p>\n

Following Spears\u2019 arrest in March, her representative told Us<\/em> that the singer understood that her actions were \u201ccompletely inexcusable.\u201d<\/p>\n

\u201cBritney is going to take the right steps and comply with the law, and hopefully this can be the first step in long overdue change that needs to occur in Britney\u2019s life,\u201d the rep said on March 4. \u201cHopefully, she can get the help and support she needs during this difficult time.\u201d<\/p>\n

Spears reunited with her sons Sean Preston, 20, and Jayden, 19, in the days after her arrest and was even spotted hanging out with songwriter Diane Warren<\/strong> and Saturday Night Live<\/em> alum Molly Shannon<\/strong>. She officially entered rehab for undisclosed treatment on April 12.<\/p>\n

Us<\/em> reported on April 15 that Spears\u2019 two sons were instrumental in convincing her to seek professional help.<\/p>\n

\u201cBritney went to rehab after several conversations with both of her sons,\u201d a source exclusively told Us. \u201cThey expressed concern about her recent behavior and urged her to seek professional help, which has been long overdue, to get her back on track. All they\u2019ve ever wanted for their mom is health and happiness, even during the years they were estranged. They hope she\u2019ll take it seriously.\u201d<\/p>\n
